急! 我能否告上一位業主及經經紀及驗屋師

我在2009年6月找了一位地產經紀幫我去找房子, 他帶了我去看一間他還未有報上公司的房屋,當作為我們與賣家的私人交易. 我之後有找驗屋師去驗房, 他只說房子有的是很少問題, 什麼發霉或漏水都沒有. 而我本人看到浴室的浴缸牆上有很多白色物塗抹上去, 我問賣家那處是否有漏水或發霉, 他說沒有, 只是有一些水跡不好看所以把它塗上白色. 然後我在2009年12月才搬進去, 但我住了半個月我發現浴室的浴缸牆上有很多霉發出來, 我就很生氣, 那是賣家說謊, 所以我們找人來把那浴缸除去換了一個站浴及把牆遮蓋, 但好景不常, 我在今年3月30號發現, 我的地庫有水, 那些水是從地底及牆上走進來的, 而且牆上也有曾經塗抹過的物品及有霉菌, 這証明了是賣家之前也曾經有漏水的情況發生, 但他就沒有告訴我們.
我想請問, 現在我能什麼辦? 誰要負責? (1)能否告賣家不誠實交易? (2) 能否追究我的維修費? (3) 幫我去驗房的驗屋師要否負責? (4) 那經紀之前也說如果那浴室的浴缸牆上真的有發霉他會負責, 那我是否真的可以要他賠償我的損失?

Normally you can sue the previous owner for the hidden defects of the house if the seller didn't claim that the sale has no legal warranty. If the sale does not have legal warranty , you can sue the inspector.
You better go ask a lawyer, if you really want to sue them.

Representations          and Disclosure of Defects

       Whenbuying a home, both the          buyer and the seller have responsibilities. The buyer has aresponsibility          to use "due diligence" to inspect the property in order todiscover          any "patent" defects. Patent defects are those that are not          hidden and may be discovered by a reasonable inspection. Thereis a rule          called "caveat emptor" (or buyer beware) that means that if          the buyer does not inspect the property, he cannot latercomplain of defects          which are not inconsistent with the seller's representationsabout the          property.
       However,the seller (or their          agent) may not conceal or mislead the buyer about defects thatwould otherwise          be evident. Such action could be fraudulent, thereby permittingthe buyer          to cancel the contract.
       Besidespatent defects, which          are obvious, there can also be "latent" defects. These would          not be revealed by a reasonable inspection. Although there is noimplied          warranty that a property is of any particular quality, if theseller knows,          or could be expected to know that the buyer would not purchasethe property          if they were aware of the latent defect, the seller has aresponsibility          to disclose such defects to the buyer.
       Ingeneral, if the seller did          not commit fraud, the buyer can not legally complain if he orshe finds          a defect in quality, for example a leaking roof, after the sale.Therefore,          before the sale, you must investigate the property fully. Somebuyers          make the purchase subject to inspection of the house by anexpert, usually          a certified home inspector.
       Standard-formcontracts of          purchase and sale provide that there are no representations,warranties,          guarantees, promises, or agreements except those contained inthe agreement.          If the seller makes representations ("promises") about thequality          of the property have them written into the agreement. The buyerasks the          seller to make written representations about the quality of theproperty          in the property condition disclosure form. The seller respondsto a list          of questions which becomes part of the contract.
       Ifyou are buying a new house,          you will similarly need express written warranties as to thequality of          the building and agreement that the builder will repair defectsfound          during the term of the warranty. Some builders providewarranties under          the New Home Warranty Program.

我买的房子好象也有过屋顶漏水, 验屋师根本看不出来, 估计卖家就把天花板补好了, 等再漏才看出来. 但是起诉他们有难度, 一个是手续太烦, 一个是证据不足, 而且签OFFER时好象说维修费在1万以下的不算. 反正我们只好花了钱在屋顶上打了补丁. 后来索性花大钱把屋顶整个换了, 不过也没超过1万.

你家的问题, 如果不是管道漏水, 有可能是墙面上的SEALER掉了, 或者是磁砖或地砖之间的GROUT松了, 容易渗水, 或者是CHULKING的问题.

2楼说的是处理这种事情的正着,买家是可以上诉owner for the hidden defects of the house,即使买房时已经验过房。想解决问题别总发帖,去找律师。
