请教大家有关vacation pay的问题

在公司工作大约9个月,因为有事情就辞职了“不是辞退“。是否可以拿到这9个月的4%?可是老板说工作没有一年没有这个钱。查了好多的法律法规也没找到。
请懂的人说说

If an employer dismisses an employee who took his vacation early and received his indemnity, is the employee entitled to the 4% or 6% of his wages when he leaves?

Yes. The employer must pay him the 4% or 6% of the wages he earned during the current reference year. The vacation that he had taken prior to his dismissal was that which he had accumulated in the previous year.

但是我不是被解聘的。我看法规说,即便我没工作一年也可以有vacation,但是没说有vacation pay。

所有的薪水(农场季节工除外),雇主都需要付4%,用于支付员工的vacation,工作一年后才有1周的假期,但不等于没有工作一年就没有4%。即使自动离职,雇主也需要付4%。

看下你的pay slip,或者在你的record of employment,,看下雇主是否有计算4%。

拿着你的record of employment, 打电话告诉他们你的情况。他们会告诉你如何处理。

这种事最好去劳动局问。好像就在唐人街附近。
在哪,政府花高薪雇用一批人等着你去问、并会帮你解决。

你老板不付给你应有的4%, 他会“吃不了兜着走”的,这里是讲法律的!

这4%的vacation pay应该从你第一张工资单开始就算进去的,不应该到年终或者做满一年后一次性支付的。
这是劳工局规定的最低%,不是老板自己说了算的。是对于没有带薪假期的员工的补偿。如果公司给你带薪假期,超过2周的话就等于有4%的vacation了,也就不会额外支付这4%.
